Lexa Resume Terms of Service

1. Acceptance & Agreement

Welcome to Lexa Resume! By downloading, installing, or using our application, you agree to be bound by these Terms of Service ("Terms").

What This Means:

• These Terms form a legally binding agreement between you and Lexa Resume
• If you disagree with any part, you must discontinue use immediately
• Continued use after updates constitutes acceptance of new terms
• You must be legally capable of entering into binding agreements

2. Service Description & Features

Core Features:

• AI-powered resume generation, analysis, and optimization
• ATS keyword extraction and job description matching
• Job application tracking and salary expectation pipelines
• Cover letter and professional summary generation
• Cross-device, offline-first synchronization

Service Limitations:

• AI Accuracy:AI-generated content may contain errors. Always review before submitting to employers.
• Availability:Service may be temporarily unavailable for maintenance.
• Third-Party Dependencies:Some features rely on external AI services.
• Usage Limits:Fair use policies apply to prevent system abuse.

3. User Accounts & Eligibility

Eligibility Criteria:

• Age Requirement:Must be at least 13 years old and meet any higher minimum age required in your country
• Legal Capacity:Must have legal authority to enter agreements
• Jurisdiction:Must not be prohibited from using our services in your location
• Compliance:Agree to follow all applicable laws and regulations

Account Security:

• Provide accurate and complete registration information
• Maintain the security and confidentiality of your credentials
• Notify us immediately of any unauthorized access
• You're responsible for all activities under your account
• One account per person — no account sharing or selling

4. Acceptable Use Policy

You agree NOT to use Lexa Resume for:

Legal Violations:

• Illegal content or activities
• Copyright or trademark infringement
• Privacy violations or unauthorized data collection
• Fraud, scams, or deceptive employment practices

Security & Abuse:

• Hacking, cracking, or system exploitation
• Malware, viruses, or harmful code
• Spam or unsolicited communications
• Denial of service or network attacks

Commercial Misuse:

• Reselling access to Lexa Resume or falsely presenting the service as your own
• Reverse engineering the application except where applicable law expressly permits it
• Automated access without permission or circumventing rate limits

Enforcement Actions:

Violations may result in: Warning → Content Removal → Account Suspension → Permanent Termination → Legal Action, depending on severity.

5. Content & Intellectual Property

Your Content (You Retain Ownership Of):

• Original resumes, cover letters, and documents you create
• Your professional personal data and career history
• Content extracted from files you choose to import

License You Grant Us:

• Process content through AI for resume and career features
• Store and sync your data securely across your devices
• Synchronize data and provide customer support

Lexa Resume Owns:

• Lexa Resume application software and AI architecture
• User interface, algorithms, and design assets
• Trademarks, logos, and branding — you may not use without permission

Copyright Claims:

To report alleged copyright infringement, contact legal@lexaresume.com with a description of the protected work, the allegedly infringing material, your contact information, and evidence that you are authorized to act for the rights holder.

6. AI Services & Third-Party Integrations

Lexa Resume uses Google Gemini through Firebase AI to provide AI-assisted career tools.

Important Disclaimers:

• AI responses may contain errors — always review content before submitting to employers
• Content required for an AI request is sent to Google when you initiate the feature
• We do not control Google's service availability or model output
• AI content should not be taken as career or legal advice
• You are responsible for ensuring that submitted information and generated output are accurate, lawful, and appropriate for your use

7. Subscriptions & Payments

Plans and Pricing:

• Available features, limits, billing periods, and prices are displayed in the app or applicable app store before purchase
• Free trials or promotional access may be offered subject to the terms shown at enrollment
• We may change pricing prospectively; changes to an existing subscription apply as permitted by the billing platform and applicable law

Billing & Renewals:

• If a plan automatically renews, that fact and its billing period will be disclosed before purchase
• Purchases are processed by Google Play or Apple App Store, as applicable
• You must manage cancellation through the store account used for purchase
• Deleting Lexa Resume or your Lexa account does not automatically cancel an app-store subscription

Refund Policy:

• App Store:Apple's refund policy applies
• Google Play:Google's refund policy applies
• Any additional refund rights required by applicable consumer law continue to apply

8. Privacy & Data Protection

Your privacy is fundamental to our service. Our comprehensive Privacy Policy details how we handle your career data:

• When and with whom we share information
• Your control over your data

Data Protection:

• Encryption and security measures protecting your resumes and data
• Data retention policies and international transfer safeguards

9. Service Availability & Modifications

App Updates:

• We may update features, functionality, and the user interface at any time
• Updates may be automatic or require manual installation
• Continued use constitutes acceptance of updates

Service Availability:

• We aim to keep the service available but do not guarantee uninterrupted operation
• Planned maintenance will be announced when possible
• Emergency maintenance may occur without notice
• Third-party AI service outages may affect certain features

Feature Changes:

• Features may be added, modified, or removed
• Material changes will be communicated where reasonably possible or legally required
• Premium features may change between subscription tiers

10. Account Termination

Voluntary Termination:

• Delete your account anytime in app settings
• Export your resumes and data before deletion
• Subscription cancellation must be done separately through the relevant platform
• Data deletion follows our Privacy Policy

Involuntary Termination:

• Terms violations or prohibited activities
• Suspected fraud or security threats
• Legal or regulatory requirements

Effect of Termination:

• Immediate loss of access to account and content
• Data deletion according to our Privacy Policy
• No refunds for remaining subscription periods

11. Legal Disclaimers & Limitations

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We Disclaim All Warranties Including:

• Merchantability:Fitness for commercial use
• Fitness for Purpose:We cannot guarantee our app will result in employment
• Accuracy:Correctness of AI-generated resume content
• Reliability:Uninterrupted or error-free operation

Damage Caps:

• To the maximum extent permitted by law, Lexa Resume will not be liable for indirect, incidental, special, consequential, or punitive damages
• Where liability cannot be excluded, total liability is limited to the greater of $100 USD or the amount you paid for the service during the 12 months before the claim
• These limitations do not apply where prohibited by law or to liability that cannot lawfully be limited

12. Indemnification

You agree to defend, indemnify, and hold harmless Lexa Resume from claims arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of third-party rights
• Content you upload or share
• Your negligent or wrongful conduct

Coverage includes legal fees, court costs, and settlement amounts.

13. Governing Law & Disputes

Applicable Law:

• Lexa Resume is offered internationally. The laws and mandatory consumer protections applicable to your use may depend on your country of residence, the place of purchase, and other legally relevant circumstances
• Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded under applicable law

Dispute Resolution:

• Informal Resolution:Contact us first to resolve disputes
• Courts:Unresolved disputes may be brought before a court with lawful jurisdiction

14. Additional Terms for EU/EEA Consumers

If you are a consumer in the European Union or European Economic Area, the mandatory consumer-protection laws of your country continue to apply and prevail over any conflicting provision of these Terms.

Digital Services & Remedies:

• You are entitled to digital content and services that conform to the contract and to remedies required by applicable EU and national law if they do not
• Nothing in these Terms excludes mandatory rights to have a service brought into conformity, receive a price reduction, or terminate a contract where applicable
• A material modification that negatively affects your access or use may give you additional notice and termination rights under applicable law

Withdrawal & Refunds:

• Where the statutory right of withdrawal applies to an online purchase, you may withdraw within 14 days without giving a reason
• The withdrawal right may be affected after digital performance begins only where the conditions required by law, including any required express consent and acknowledgement, have been satisfied
• For an app-store purchase, submit withdrawal or refund requests through Google Play or Apple App Store, without limiting any rights you have against Lexa Resume under applicable law

Governing Law & Courts:

• These Terms do not deprive you of mandatory protections provided by EU law or the law of your country of residence
• You may bring a consumer claim in the courts available to you under applicable EU and national jurisdiction rules
• The warranty disclaimers, liability limits, and indemnity provisions apply only to the extent permitted by mandatory consumer law

15. Updates & Changes

We may update these Terms to reflect changes in our service, legal requirements, or business practices.

• Material Changes:Additional notice where reasonably possible or legally required
• Minor Changes:Updated "Last Modified" date on this page
• Continued Use:Constitutes acceptance of the updated terms

If you disagree with changes, you may terminate your account before they take effect.
